"GEN-U-WIN" PROMOTION

TERMS AND CONDITIONS

  1. Information on how to enter, register and details of the prizes for the "Gen-U-Win 2" promotion ("Promotion") form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.

Promoter

  1. The promoter is BlueScope Steel Limited (ABN 16 000 011 058) of Level 11, 120 Collins Street, Melbourne, VIC 3000, telephone: 1800 263 191 ("Promoter").

Eligibility Requirements

Homeowner Eligibility

  1. Subject to clause 5, homeowner entry is only open to individuals who meet the following requirements:
    1. are an Australian resident homeowner aged 18 years or older;
    2. have purchased one (1) or more COLORBOND® steel products totalling a minimum of $200 including GST (material only - excludes installation and delivery costs) for a residential property they own, from any business or businesses in Australia (which sells genuine COLORBOND® steel products), between 1 May 2015 and 29 February 2016 ("Eligible Purchase"). For the sake of clarity, the $200 minimum spend requirement may be made across multiple transactions (e.g. $100 on genuine COLORBOND® steel product/s in one transaction, and $100 on genuine COLORBOND® steel product/s in another transaction. In addition, the minimum spend may be made across multiple businesses); and
    3. where part or whole of the Eligible Purchase is for a roof, then the roof must be installed (or if not yet installed, must be planned to be installed) using genuine COLORBOND® steel all-round (i.e. fascia, guttering and flashing must all be made from genuine COLORBOND® steel products. However, if the Eligible Purchase is for a COLORBOND® steel gutter then they are not required to also have a COLORBOND® steel roof/fascia to be eligible for entry, ("Eligible Homeowner").
  2. For the sake of clarity, the Promoter will make a call out to a provisional winner's property at which a roof has been installed to verify clause 3c) requirements have been met or will take other verification measured deemed necessary before awarding a prize.
  3. Homeowner entry is not open to directors, management, employees, officers and contractors of the Promoter who are directly involved in the management of the Promotion (and their Immediate Families) or of the agencies, businesses which sell genuine COLORBOND® steel or organisations associated with this Promotion. "Immediate Families" means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor.

Trade Eligibility

  1. Trade business registration is only open to businesses that supply and/or install genuine COLORBOND® steel products in Australia and have a valid ABN, excluding businesses which are owned by the Promoter other than businesses that are a franchisee of the Promoter ("Eligible Businesses").

    No trade prize will be awarded to an owner, manager, employee of an Eligible Business who is also a director, a part of management, an employee, an officer or contractor of the Promoter who is directly involved in the management of the Promotion or an agency associated with this Promotion (or an Immediate Family member of such person). If an Eligible Homeowner nominated such a person on entry and is drawn a winner, the relevant trade prize will then be awarded to another person at the Eligible Business at which such person is employed or the Eligible Business directly, as determined by the Promoter in its absolute discretion.

Promotional Period

  1. Promotion commences on 12.00am AEST 1 September 2015 and ends at 11.59pm AEDST on 29 February 2016 ("Promotional Period").

How to Enter (Homeowners)

  1. To enter, an Eligible Homeowner must visit COLORBOND.COM/GENUWIN, follow the prompts to the homeowner entry page, input the requested details including details of their Eligible Purchase (e.g. the business from whom the Eligible Purchase was made (including the business's office and location) and if known, the name of the employee/manager/owner from the business who sold them COLORBOND® steel) and submit the fully completed entry form during the Promotional Period. Eligible Homeowners may also be provided with the option to enter via iPad/computer in selected stores. For the sake of clarity, if an Eligible Homeowner makes their Eligible Purchase across multiple businesses (e.g. $100 spent on genuine COLORBOND® steel product/s at one (1) business, and $100 on genuine COLORBOND® steel product/s at another business), then an Eligible Homeowner only needs to nominate one (1) of those businesses (of their choice) on the entry form.
  2. An authorised representative of an Eligible Business ("Authorised Representative") may enter an Eligible Homeowner into this Promotion on their behalf. Authorised Representatives may collect all required details verbally or in writing from an Eligible Homeowner and then either enter this onto the online homeowner entry form on the Eligible Homeowner's behalf [or pass these details onto the Promoter for the Promoter to include the Eligible Homeowner into the Promotion]. Any such steps for collection of an Eligible Homeowner's personal data (and other information for entry) must take place during the Promotional Period and be submitted through the official online entry form and/or provided back to the Promoter, by the end of the Promotional Period, to be eligible for entry into the draw.
  3. Maximum one (1) homeowner entry permitted per person.
  4. Eligible Homeowners must retain their original invoice or receipt for their entry as proof of purchase. Failure to produce the proof of purchase for their entry when requested may, in the absolute discretion of the Promoter, result in invalidation of the Eligible Homeowner's entry and forfeiture of any right to a prize. Purchase receipt(s)/invoice(s) must clearly specify the Eligible Business of the Eligible Purchase and that the Eligible Purchase was made between 1 May 2015 and 29 February 2016 but prior to entry.

How to Enter (Trade)

  1. For an Eligible Business to register for the trade element of this Promotion, an Authorised Representative of the Eligible Business must visit COLORBOND.COM/GENUWIN/SUPPLIER, follow the prompts to the trade registration page, input the requested details (including details of their COLORBOND® steel supplier, and Eligible Business's ABN) and submit the fully completed registration form during the Promotional Period.
  2. Businesses that supply COLORBOND® steel to an Eligible Business, e.g. rollformers ("Eligible Suppliers") may register the Eligible Business for this Promotion on behalf of the Eligible Business, with that Eligible Business's consent.
  3. An Eligible Supplier must have consent from their Eligible Business to include that Eligible Business's name on the registration form.
  4. The Promoter will send trade registrants of the Gen-U-Win 1 Promotion a promotional email, and whoever receives such an email will automatically have their Eligible Business registered/opted in to the Gen-U-Win 2 Promotion. However, if the trade registrant who receives the email is not an authorised representative of their Eligible Business, they must contact their Eligible Business owner or manager to obtain consent to have their Eligible Business registered for this Gen-U-Win 2 Promotion. If consent is not provided, they must select to opt out of entry into this promotion by selecting the relevant button in the promotional email. If the trade registrant or any other person at their Eligible Business chooses to opt out of the Gen-U-Win 2 Promotion a representative of the Promoter will contact the trade registrant who opted out to ensure their records regarding whether their Eligible Business is to be registered or not for this Gen-U-Win 2 Promotion are corrected. If a recipient of the promotional email chooses to unsubscribe from marketing messages, he/she will not be eligible to win a prize if their business is registered for this promotion and they are listed as the person from whom a winning consumer entrant's corresponding purchase was made. If a person unsubscribes from marketing messages and opts their Eligible Business out of the Gen-U-Win 2 promotion, their Eligible Business and any employee of that Eligible Business will not be eligible to receive a prize.
  5. Multiple trade registrations are permitted per Eligible Business (i.e. multiple people from the same Eligible Business (including multiple people from an office of an Eligible Business) may register for this promotion). For the sake of clarity, if there are multiple offices operating under the same ABN, registration by one (1) office will register the entire Eligible Business (i.e. all offices which fall under the same ABN).
  6. All draws will take place at the Sydney Office of BlueScope Steel Limited, Building 6, 41-43 Bourke Rd, Alexandria, NSW 2015.

Major Draw & Major Prizes (1 x Homeowner prize; 1 x Trade prize)

  1. The Major Draw will take place at 2pm AEDST on 1 March 2016. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible homeowner or business is drawn.
  2. A Major Draw will be conducted from all homeowner entries received during the Promotional Period. The first valid homeowner entry drawn will win $100,000. The prize will be awarded in the form of a cheque made payable in the winning Eligible Homeowner's name.
  3. If an Eligible Business is listed on the winning Eligible Homeowner's entry form (from clause 19 above), then the eligible employee/owner/manager from whom they made their Eligible Purchase or part of their Eligible Purchase (as listed on the entry form) will also win $100,000, subject to any internal policy of the Eligible Business to which they are employed. E.g. if the Eligible Business has a policy which requires any prizes won in a competition/promotion by an employee/owner/manager to be awarded to the owner of the Eligible Business, then that will be the case (subject to approval by the Promoter). If only an Eligible Business is referenced on the winning Eligible Homeowner's entry form (and no employee/owner/manager name is also referenced), then the prize will be awarded as a cheque made payable to the listed Eligible Business. In the event of a disagreement as to whom a prize should be awarded, the Promoter's decision will be final. If the business at which the Eligible Purchase was made (as listed on the winning Eligible Homeowner's entry form) is not an Eligible Business (e.g. the business has not registered for this Promotion), then the Promoter will award the respective trade prize to the eligible employee/owner/manager nominated by the next reserve Eligible Homeowner entry drawn, subject to any internal policy of the Eligible Business to which they are employed. For the sake of clarity, in such a case, the reserve Eligible Homeowner entry drawn will NOT receive a prize. The same process will continue as outlined above until one (1) trade prize winner is determined.
  4. The Major Prize winners' names will be published in The Australian on 11 March 2016.

State Group Monthly Draws & State Group Monthly Draw Prizes

  1. Homeowner entries received for each Monthly Period (outlined below) will be divided into eight (8) "State Groups", based on the entrant's State/Territory of residence: (1) NSW; (2) ACT; (3) VIC; (4) TAS; (5) QLD; (6) SA; (7) NT; and (8) WA. Entries open and close for each State Group Monthly Draw on the dates and times outlined in the table below. Each State Group Monthly Draw is at 2pm AEST/AEDST on the dates indicated in the table below. Non-winning entries into each State Group Monthly Draw will be entered into any subsequent State Group Monthly Draw.

  2. The first valid homeowner entry drawn in each Monthly State Group Prize Draw will win $2,000. The prize will be awarded in the form of a cheque made payable in the winning Eligible Homeowner's name.
  3. If an Eligible Business is listed on a winning Eligible Homeowner's entry form (from clause 23 above), then the eligible employee/owner/manager from whom they made their Eligible Purchase or part of their Eligible Purchase (as listed on the entry form) will also win $2,000, subject to any internal policy of the Eligible Business to which they are employed. E.g. if the Eligible Business has a policy which requires any prizes won in a competition/promotion by an employee/owner/manager to be awarded to the owner of the Eligible Business, then that will be the case (subject to approval by the Promoter). If only an Eligible Business is referenced on the winning Eligible Homeowner's entry form (and no employee/owner/manager name is also referenced), then the prize will be awarded as a cheque made payable to the listed Eligible Business. In the event of a disagreement as to whom a prize should be awarded, the Promoter's decision will be final. If the business at which the Eligible Purchase was made (as listed on the winning Eligible Homeowner's entry form) is not an Eligible Business (e.g. the business has not registered for this Promotion), then the Promoter will award the respective trade prize to the eligible employee/owner/manager nominated by the next reserve Eligible Homeowner entry drawn, subject to any internal policy of the Eligible Business to which they are employed. For the sake of clarity, in such a case, the reserve Eligible Homeowner entry drawn will NOT receive a prize. The same process will continue as outlined above until one (1) trade prize winner is determined for each Monthly State Group Prize Draw.
  4. The State Group Monthly Draw winners' names will be published at COLORBOND.COM/GENUWIN/WINNERS on the dates outlined in the table above.

Winner Notification

  1. Winners will be notified in writing.

General Conditions

  1. In the event that there is any dispute to whom an Eligible Business prize must be awarded to, the Promoter's decision will be final.
  2. All cash prizes will be awarded in the form of a cheque made payable to the respective winner.
  3. The Promoter reserves the right, at any time, to verify the validity of entries/registrations and entrants/Eligible Homeowners/Eligible Businesses/Authorised Representative (including an entrant's/Authorised Representative's/Eligible Homeowner's identity, age and place of residence or an Eligible Business's address and name) and reserves the right, in its sole discretion, to disqualify any individual/Eligible Business/Eligible Homeowner who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry/registration process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  4. Incomplete or indecipherable entries/registrations will be deemed invalid.
  5. If there is a dispute as to the identity of an entrant/Authorised Representative/Eligible Homeowner/Eligible Business, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant/Authorised Representative/Eligible Homeowner/Eligible Business.
  6. The Promoter's decision is final and no correspondence will be entered into.
  7. If for any reason a winner does not take/claim a prize at or by the time stipulated by the Promoter, then the prize will be forfeited.
  8. Total prize pool value is $392,000.
  9. Prizes, or any unused portion of the prize, are not transferable.
  10. Draws for any unclaimed prizes from the respective original draws may take place on the relevant dates indicated in the table below at 2pm AEDST at the same place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing and their names will be published at COLORBOND.COM/GENUWIN/WINNERS from the dates indicated in the table below. If only a trade prize (and no homeowner prize) must be awarded in an unclaimed prize draw, then the prize will be awarded to the Eligible Business nominated by the first valid Eligible Homeowner entry drawn in such draw (that has nominated an Eligible Business which has registered for this Promotion). For the sake of clarity, in such a case, the reserve Eligible Homeowner entry drawn will NOT receive a prize.

  11. Eligible Homeowners consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. Authorised Representatives consent to the Promoter using their name, likeness, image and/or voice and their Eligible Business's name and image in the event their Eligible Business is a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. As a condition of accepting a prize, any person who is an employee/owner/manager of an Eligible Business and is determined a winner, consents to the Promoter using their name, likeness, image and/or voice and their Eligible Business's name and image (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  12. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant/Eligible Homeowner/Authorised Representative/Eligible Business; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
  13. Any cost associated with accessing the promotional website is the entrant's/Authorised Representative's/Eligible Homeowner's/Eligible Business's responsibility and is dependent on the Internet service provider used.
  14. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  15. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner, entrant, Eligible Homeowner, Authorised Representative or Eligible Business; or (f) taking and/or use of a prize.
  16. As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  17. The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.bluescope.com/media/1040/privacy-policy.pdf. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant/Authorised Representative/Eligible Homeowner/Eligible Business. The Privacy Policy also contains information about how entrants/Authorised Representatives/Eligible Homeowners/Eligible Businesses may opt out, access, update or correct their PI, how they may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrants/Authorised Representatives/Eligible Homeowners/Eligible Businesses' personal information to any entity outside of Australia.
